One more Piece of Lingering Bush Ugliness

John Yoo in an "opinion" piece- linked to by Daily Kos:

Well, let's get this part of it out of the way first:

"When she served as dean of Harvard Law School, Kagan prohibited the U.S. military from recruiting students on campus"

This is, of course, one more Republican lie. Kagan did no such thing, as is perfectly well known by anyone who has followed this story. Now on to the money quote:

"What if a college dean barred from campus recruiting any law firm that provided free representation to al-Qaida terrorists? Suppose she believes that the firms are providing aid and comfort to the enemy in wartime. "

This man is allowed to be a professor of law at one of our major universities, and held a high position in the worst presidential administration ever, where he did immense damage to our nation's standing in the world, yet he apparently does not understand one of the most basic principles of American law: the right to counsel. Mr. Yoo, I am not a lawyer, but I can read:

"AMENDMENT 6
In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the Assistance of Counsel for his defence."

Here we have the perfect Conservative "strict constructivist" with his commitment to the views of our founding fathers- as long as he can twist them into appearing to support whatever disgusting position he wants to take. Otherwise, the plain language and intent of the constitution is out the window without a second thought. These people are corrupt liars who do not want a democratic government, but rather a police state which exists solely for the benefit of the hyper rich, and to hell with the rest of us.

This is not a criminal prosecution, however. This is a military matter as we are at war with a terrorist organization. Also, many of said terrorists are detained overseas.
